Terms and Conditions Agreement

PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR USING THIS PROMOTIONAL PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE KOI THE THAILAND APPLICATION OR PARTICIPATE IN KOI LEAF REWARDS (THAILAND) PROGRAM.

These Terms of Use apply to your access to, and participation in, KOI Leaf Rewards (“KOI Leaf Rewards”) program which is operated by KOI THE (Thailand) Co., Ltd (“KOI Thé Thailand”) These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with KOI Thé Thailand for products, services or otherwise. KOI Thé reserves the right to change, modify and/or eliminate the KOI Leaf Rewards program and/or these Terms of Use or any policy, FAQ, or guideline pertaining to KOI Leaf Rewards at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to KOI Thé TH Application, and you waive any right you may have to receive specific notice of such changes or modifications. Your participation in the KOI Leaf Rewards confirms your acceptance of these Terms of Use and any such changes or modifications; therefore, you should review these Terms of Use and applicable policies and FAQs frequently to understand the terms and conditions that apply to KOI Leaf Rewards. If you do not agree to the Terms of Use, you must stop participating in KOI Leaf Rewards.

Eligibility ,Registration and Account

KOI Leaf Rewards program is not targeted towards, nor intended for use by, anyone under the age of 20.If you are under 20 ,you may only use the program under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.

In order to participate in certain areas of our sites, you will need to register for an account. You agree to (a) create only one account; (b) provide accurate, truthful , current and complete information when creating your account; (c) maintain and promptly update your account information; (d) maintain the security of your account by not sharing your password with others and restricting access to your account and your mobile phone; (e) promptly notify KOI Thé Thailand if you discover or otherwise suspect any security breached relating to the Sites.We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions; and ( f ) take responsibility for all activities that occur under your account and accept all risks of unauthorized access.

KOI Thé Thailand reserves the right to terminate your account and/or your participation in KOI Leaf Rewards if KOI Thé determines in its sole discretion that you have violated these Terms of Use, or that the use of your account is unauthorized, fraudulent or otherwise unlawful.

KOI Leaf Rewards Program

Please note that the KOI Card issued by KOI The (Thailand) Co.,Ltd, is a prepaid card with stored value, and this Agreement sets out the terms of use for our KOI Card.

Users are advised to read the following Terms of Use Agreement that applies to your prepaid KOI Card with stored value.

Please register your KOI Card on our KOI Thé TH App to protect and secure your card in case of any lost or stolen cases.

KOI THE (Thailand) Co.,Ltd. does not represent or warrant that your KOI Card will always be accessible or accepted at participating outlets.

ABOUT YOUR KOI CARD

The KOI Card is issued by KOI The (Thailand) Co.,Ltd. You can load monetary value in the KOI Card for future purchases only in Thailand. The KOI Card may be used at all participating KOI outlets. The KOI Card balance cannot be protected if lost, stolen or destroyed unless you have registered it and reported the loss on our KOI Thé TH App.
No credit card, credit line, overdraft protection or deposit account is associated with KOI Card.
We reserve the right not to accept your KOI Card if we believe that the use of the card is unauthorized or unlawful.
The value you top-up in the KOI Card cannot be exchanged for cash or credit balance except as provided in this Agreement.

✦ PURCHASE & LOAD YOUR KOI CARD

You can purchase a KOI Card at any participating KOI outlets. Top-Up can be done at any participating KOI outlets with a minimum Top-Up value of 100 Baht. You can top-up by Cash or Credit/Debit Card at cashier counter. KOI Thé reserves the right to change the maximum and minimum Top-Up amount without any prior notice.
Your account has no expiry date .

✦ REGISTER YOUR KOI CARD

You may register your KOI Card on KOI Thé TH Mobile Application (Android or IOS) to protect your balance and enjoy exclusive member rewards. We will use your registered email as your account ID. Each email address will only be able to register one time, and maximum 10 unregistered Cards can be added and shared under the same account. The maximum stored value for each account at any point of time is 10,000 Baht and increasing in multiples of 50 Baht.
All vouchers, balance and Leafs collected are shared among all cards under the same account, you may bring any of the cards / e-cards on KOI Thé TH App under the same account to enjoy the rewards . Member’s benefits like Birthday Voucher will be issued once per registered account.
Your KOI Card balance, Leafs, vouchers and account under this membership portal is personal to you, and may not be sold, transferred or assigned to, or shared with anyone else.

✦ KOI CARD BALANCE

You can check your KOI card balance or review the last ten recent transactions by signing in to your member account on KOI Thé TH App.
You should keep your receipts after purchase was made by KOI Card and check your online statement to ensure that your account balance is correct.
KOI Thé reserves the right to correct the balance of your KOI Card if we find an accounting/payment error. If you have any questions regarding your transaction, please contact us at 02-274-1500 or e-mail customercare-th@koicafe.com Please note that, transaction in query can only be made within 60 days, based on the date of transaction.

✦ FEES AND EXPIRY DATE

There is not fees upon issuance, activation ,use or reloading your KOI Card as well as no expiration date.

✦ CARD LOSS REPORT

Your KOI Card balance and rewards are protected under main account. If your KOI Card is lost, stolen or destroyed, you should “Report Lost Card” to deactivate the usage of the lost card at KOI Thé TH App immediately, and reactivate it once you find it. The rest of the cards under the same account can be used as per normal. You may even “Cancel Card” to terminate the usage of the card(s) permanently. Card(s) once cancelled, cannot be reactivated again.

✦ CARD REFUND

Refund is not available for KOI Card and may not be exchanged for cash or credit balance unless required by law or permitted by the terms of this agreement.

ABOUT YOUR KOI Leaf Rewards

For new card holders, there is a minimum Top-Up of 100 Baht (amount subjected to the card design and outlets). You can top-up by Cash or Credit/Debit Card at cashier counter.

You may protect the balance in your card and enjoy more rewards by registering as a member on KOI Thé TH App . The following promotions are only applicable for registered members :

Enjoy 1 free Birthday beverage
- Green Level : small-sized beverage
- Golden Level : medium-sized beverage
Get double leafs for the first purchase after registration of new account.
Linked multiple cards (up to 10 cards)
Exclusive members’ events and rewards are offered from time to time.
Collect 1 Leaf for every 25 Baht when you spend with KOI Card. The Leafs will be calculated based on the spending amount of each single receipt. E.g. 180 Baht spent, 180 Baht / 25 Baht = 7.2 Leafs rewarded. The 0.2 leafs will not be shown in Profile page, but do note that we count every single Baht you spent !
- Leafs are for promotional purposes only and have no cash value. Please note that Leafs accumulation and special member promotions will only be eligible for time you register your card.
- Leafs will expire in one year from the month you are rewarded (eg. Leafs earned on 1st January 2021 will expire on 31st January 2022). You may use the Leafs in your account to redeem available vouchers on our KOI Thé TH App.
- Vouchers will be credited into your account once the redemption is confirmed. For voucher redemption, please present e-voucher from you signed account at all participating KOI outlets. The rewards are not valid with other promotions. Expired vouchers will be forfeited, extension of expiry date is strictly not allowed.

All rewards/redemption are subjected to availability and while stocks last basis. Members are to visit other outlet(s) if merchandise is sold out at specific outlet to comeback another day to redeem. KOI Thé Thailand reserves the right to change the free merchandise/rewards without prior notice.

✦ PRIVACY STATEMENT

Please read the Privacy Policy carefully to understand how KOI Thé collects, uses and discloses information about its customers and how to update or change your personal information and how we communicate with you.

We may automatically collect online information when you visit our site. If you have registered as a member and agreed to receive e-mail or similar messaging applications from us, we may use your information to send you our marketing related campaign , promotions and exclusive member events; for better understanding of our members, we may use the information to do data analysis, research and customer service improvement. We take responsibility to secure your personal information, however, we may share it in limited ways with our parent company, promotion cooperative partners and card service providers.

✦OTHER LEGAL TERMS

We may amend these Terms and Conditions from time to time in our sole discretion without notice to you. Any additional, amendment or deletion will take effect at the time we post it on our KOI Thé TH App.
If you do not agree to the changed Terms and Conditions, please contact us in writing to the contrary within twenty (20) days from the date the new or additional terms are posted on our KOI Thé TH App. If you do not accept the changes, additions or deletions, you should stop using the KOI Card.
We may terminate this agreement at any time by giving prior notice. However, prior notice will not be given if immediate termination is required. E.g. Any unauthorized or fraudulent use of KOI Card.
KOI THE (Thailand) Co.,Ltd. does not warrant that your KOI Card will always be accepted at all participating KOI outlets.
KOI THE (Thailand) Co.,Ltd. will not be liable for any loss or damage incurred by you. The company will not be responsible for any delay or mistake made related to your KOI Card due to any unforeseen circumstances.

✦ EXCLUSION OF LIABILITY

Notwithstanding any other terms or conditions in these Terms and Conditions, we shall not be liable to you for any loss, damage, inconvenience, moral distress, cost and expense of any nature (including, without limitation for any act, omission, neglect or willful default on the part of our vendors, contractors, correspondents and/or their respective officers and employees) which in any way may be suffered or incurred by you or by any other person in respect of or in connection with the KOI Leaf Rewards Program, including without limitation, your Account, Membership, Rewards or Redemption and/or in connection with the collection, use, disclosure and/or processing of your Personal Data in accordance with these Terms and Conditions.You will release and discharge us from all claims in relation to the aforesaid loss,damage, inconvenience, embarrassment, cost and/or expense.
We shall also not be liable for any direct, incidental or consequential damage or loss suffered by you that may result from the collection, use, disclosure and/or processing of your Personal Data, including but not limited to any loss of, or any inability to retrieve, any Personal Data, howsoever caused, or any inaccuracy in the Personal Data presented, used or transmitted whether over the internet or any public network may be subject to loss, interception and misuse.
You may not register a KOI Card which was issued or activated outside Thailand.
