POLICY NOTICE

KOI Thé cares about the privacy of our customers.

The privacy notice is provided to inform our customers of our policy in relation to the collection, use and disclosure of personal data of individual (“you”) in accordance with the Personal Data Protection Act B.E. 2562 (“PDPA”), relevant laws and regulations. 

This KOI Thé Privacy Policy ("Policy") describes details and how KOI THE (Thailand) Co., Ltd. and its parents and other affiliated companies (collectively "KOI Thé") collects, uses discloses and/or cross-border transfer personal information of our customers. 

 

This Policy applies to the Personal Information of (1) our individual clients or customers, and (2) employees, personnel, officers, representatives, shareholders, authorized persons, members of the board of directors, contact persons, agents, and other natural persons in connection with our corporate clients or customers, which KOI Thé collects through our websites, mobile applications, and online services (collectively, the "Sites"), or through our programs, our physical stores, or marketing events ("Services"), or any other activities that owned or operate by KOI Thé. 

 

This Policy does not apply to websites and services that display or link to different privacy statements. Websites and services co-branded with other partners may display or link to a joint privacy statement or separate privacy statements of our partners in addition to our Policy.

Information collection 

 

Personal information which identifies you, either directly or indirectly, as an individual (the "Personal Information") that may be collected by KOI Thé may include:

  • Title, name, surname, gender, nationality, postal address, phone number, and e-mail address.

  • Financial account information, such as credit or debit card number and other payment information.

We may also collect additional information about you such as:

  • ​If you create an account - your username, password, your city of birth, your birthday, gender, nationality and mobile phone number.

  • If you buy goods at our stores or through our programmes or otherwise – how much you buy, where you buy, how frequently you buy, rewards you earn, and reward you redeem.

  • If you register any KOI Thé Card – the card number, card transactions, including activating the KOI Thé Card, loading value to the KOI Thé Card, redeeming any value, balance transfer, balance enquiries.

  • If you take a survey or interact with us in various other ways - demographics information, your comments, feedback, questions or suggestions, and information about subjects that may interest you.

We may automatically collect online use information when you visit our Sites or use our Services. This information may include information about your Internet service provider, your operating system, browser type, domain name, Internet protocol (IP) address, your access times, the website that referred you to us, the Web pages you request, and the date and time of those requests. Our collection of online use information may involve the use of cookies and Web beacons. Cookies are small data files stored on your hard drive by a website. Among other things, cookies help us improve our Sites and your experience. We use cookies to see which areas and features are popular and to count visits to our Sites. Web beacons are electronic images that may be used on our Sites or in our emails. We use Web beacons to deliver cookies, count visits, understand usage and campaign effectiveness and to tell if an email has been opened and acted upon. 

 

 

KOI Thé may also collect aggregated data or anonymized data that does not directly identify you. We may combine information we collect about you with information we receive from third parties.

 

 

In some instances, KOI Thé may combine other information with Personal Information.  If other information is combined with Personal Information or if other information is used to identify an individual, such information will be treated by us as Personal Information.

Personal Information related to third parties 

 

If you provide the Personal Information of any third party (such as your spouse and children) to us, e.g. their name, family name, email address, and telephone number, you should ensure that you have the authority to do so and to permit us to use the Personal Information in accordance with this Policy. You are also responsible for notifying the third party of this Policy and, if required, obtaining consent from the third party.

Personal Information of minors, quasi-incompetent persons and incompetent persons

 

Generally KOI Thé may do not knowingly collect Personal Information from minors (those who have not reach the legal age (20 years of age or by marriage)) without their parental consent (except those allow by law) when it is required, or from quasi-incompetent persons and incompetent persons without their legal guardian's consent. If you are a minor, quasi-incompetent or incompetent person and wish to engage in a relationship with us, you must obtain the consent from your parent or legal guardian prior providing us with your Personal Information.

If KOI Thé learn that KOI Thé have unintentionally collected Personal Information from any minor without parental consent (except those allow by law), or from quasi-incompetent person or incompetent person without their legal guardians' consent, KOI Thé will immediately stop using such personal information delete it, except the case that KOI Thé is authorized to using such Personal Information by relying on other legal bases apart from consent.

Use of Personal Information 

 

For the purpose of selling goods, providing services, or making any business communication with you or the juristic person that you have been working with, it is necessary for KOI Thé to collect, use, disclose, and/or cross-border transfer your personal data and sensitive data to third party or to the transfered outside Thailand (if any) for the purpose of conducting our business, providing service, making business contact, communication, establishment or comply with statutory rights, and communication with external organization, to comply with our obligations, for our business purpose, to comply with relevant laws, and/or for the benefits of the Company and/or the Patient. We will strictly follow the provisions of this Privacy Policy.

KOI Thé may collect, use or disclose your Personal Information insofar as this is necessary to perform the contract for the provision of the Services, or to improve our Services, in accordance with the criteria set out by this Policy, unless you have consented to further processing of your Personal Information.

  • Purpose for Which KOI Thé May Rely on Other Legal Grounds for Processing Your Personal Data

KOI Thé may collect, use, disclose, and/or cross-border transfer your Personal Data to third party or to the transferee outside Thailand (if any) by relying on the following legal grounds without obtaining your consent: 

​

  1. a contractual basis, for our initiation or fulfilment of a contract with you; 

  2. a legal obligation; 

  3. the legitimate interest of ourselves and third parties, to be balanced with your own interest and fundamental rights and freedoms in relation to the protection of your Personal Data; 

  4. vital interest, for preventing or suppressing a danger to a person’s life, body or health; and 

  5. public interest, for the performance of a task carried out in the public interest or for the exercise of official actions.

 

KOI Thé rely on the legal grounds in (1) to (5) above to collect, use, or disclose your Personal Information to the extent permitted or required under applicable law, for the following purposes:

  • Process and manage your purchase and use of KOI Thé products and services, including your accounts and program participation, your use of the Sites.

  • Respond to your customer service inquiries, post your comments or statements on any blog or other online forum maintained on our Sites, or take other actions in response to your inquiries or other Site activities.

  • Communicate with you by post, telephone, email and SMS about your orders or purchases, your services, accounts and programme participation, a contest or sweepstakes you have entered, and your requests for information.

  • Enforcing our legal or contractual rights which you have with us including, but not limited to, recovering any and all amounts owed to us

  • Security monitoring, such as authentication, usage controls, monitoring of system, access control, etc.

  • To comply with obligations imposed by any applicable law.

  • Purpose for Which Consent is Required Prior to Processing Your Personal Data

KOI Thé will process your Personal Data for the following purpose only if we receive your consent:

  • Provide marketing communications, special offers, promotional materials about the products and services of the Company, our affiliates and subsidiaries and the third parties which we cannot rely on other legal grounds;

  • Create personalized promotions by combining your Personal Information with non-personal information about you, such as the amounts and types of purchases you make or any benefits you receive through our programs.

  • Communicate with you by post, telephone, email and SMS about our brands, products, events or other promotional purposes, including co-branded offers and affiliate and partner offers.

  • Request feedback or participation in surveys, conduct market research and/or analysis for statistical, profiling or other purposes for us to review, develop and improve the quality of our Services, and test and improve our systems, and prevent the misuse or improper use of our Services.

  • Developing new services and products and updating you on our services and products from time to time;

  • Carrying out research, planning and statistical analysis for the purpose of developing our services and products;

 

Sharing Information

 

KOI Thé shares your Personal Information to others in limited ways as follows :

  • We may share your Personal Information with others with your consent.

  • We may share your Personal Information with our parent and other affiliated companies.

  • We may share your Personal Information with our business partners.

  • We may also share your Personal Information with entities that provide support services to us (such as credit card processors or other payment services providers, mailing houses or website hosts, IT service provider, data analytic providers) and entities that help us market our products and services (such as email vendors, survey, marketing and/or communication representative,). These companies may use your Personal Information to perform their functions on our behalf.

  • We may disclose specific information (i) upon lawful request, in response to legal process, and when required to comply with laws, (ii) to enforce our agreements, corporate policies, and terms of use or (iii) to protect the rights, property or safety of KOI Thé , our employees, agents, customers, and others.

  • If you participate in any blog or other online forum on our Sites, any Personal Information that you post on our Sites may be shared with other forum participants and Site visitors.

  • In the event of a merger, acquisition, financing, or sale of assets or any other situation involving the transfer of some or all of our business assets, KOI Thé may disclose your Personal Information to those involved in the negotiation or transfer.

 

KOI Thé will only provide your Personal Information to others only that is necessary for them to know. KOI Thé will ask them not to use your Personal Information for any other purposes, and will take steps to ensure that such person will keep your Personal Information secure, such as confidentiality arrangements or other appropriate security measures as required by law.

 

International Transfer of Personal Information

 

We may transfer your Personal Information to the countries outside of Thailand to our parent and other affiliated companies and our third party service providers as part of our normal business operations to perform our Services (i.e., our IT service provider), that from the standpoint of the data protection supervisory authority in Thailand, may or may not have an "adequate standard of Personal Information protection" as specified by the data protection supervisory authority in Thailand.

KOI Thé will take steps and measures to ensure that your Personal Information is securely transferred, that the data recipients have suitable data protection standards in place, and that the transfer is lawful by relying on the derogations as permitted under the law.

Personal Information Retention

 

Your Personal Information collected, used, or disclosed for the purposes hereunder will be stored only to the extent necessary during the term of your participation in the Services with us, or for the period necessary to fulfil the purposes outlined in this, including during a transition period (e.g. for the compliance of our obligations regarding data retention as established in applicable laws), if any.

In principle we will retain your Personal Information as long as required or permitted by applicable law. Afterwards, we will remove your Personal Information from our systems and records and/or take steps to properly anonymize it so that you can no longer be identified from it.

Personal Information Subject Rights

 

You have the following rights under the conditions set out under applicable law 

  • Right of access: You have the right to obtain from us the access to your Personal Information under our responsibility, or request that we disclose how your Personal Information is obtained. You have the right to obtain a copy of your Personal Information undergoing collecting, using, or disclosing. For additional copies requested by you, we may charge a reasonable fee based on administrative costs as permitted by applicable law. 

  • Right to rectification: You have the right to obtain from us the rectification of your inaccurate Personal Information to be accurate, up-to-date, completed, and not misleading. 

  • Right of restriction: You may have the right to restrict our processing of your Personal Information if you believe such data to be inaccurate, that our processing is unlawful, or that we no longer need to process this data for a particular purpose;

  • Right to erasure: You have the right to ask us to erase, destroy or temporarily suspend the use of your Personal Information, or convert your Personal Information into data which cannot identify you.

  • Right to data portability: You have the right to receive your Personal Information which you have provided to us in a commonly used and machine-readable electronic format and your Personal Information can be used or disclosed by automatic means, unless it is impossible by technical circumstances. You also have the right to request us to directly send or transfer your Personal Information in such formats to other data controller if it can be done by the automatic mean. 

  • Right to object: You have the right to object to collection, use or disclosure of Personal Information, which is carried out to protect our legitimate interests or for performance of tasks in the public interest, at any time, in accordance with the statutory provisions.

If you file an objection, we may continue to collect, use or disclose your Personal Information if we can document mandatory and legitimate reasons that we are authorized to use such Personal Information by relying on other legal basis which is outweigh your interests, rights and freedoms, or if collection, use or disclosure is for the assertion, exercise or defense of legal claims, as may be applicable.

  • Right to revoke consent: If you have consented to collection, use or disclosure of your Personal Information by us, you have the right to withdraw your consent at any time, without affecting the lawfulness of our processing based on such consent before it was withdrawn. 

  • Right to lodge a complaint: You may have the right to lodge a complaint to the competent authority if you believe our processing of your Personal Data is unlawful or non-compliance with applicable data protection law.

Please note that the aforementioned rights might be limited under the applicable national data protection law. We remain the universal point of contact for your execution of these rights.

KOI Thé offers choices for you to request to update or change your Personal Information and how we communicate with you. Follow the opt-out instructions in promotional emails we send you.

If you opt out of receiving promotional communications from us, we may still send you non-promotional communications.

You can usually choose to set your browser to warn you when a cookie is being sent or to remove or reject cookies. Each browser is a little different, so look at your browser Help menu to learn the correct way to modify your cookie settings. If you choose to remove or reject cookies, it will affect many features or Services on our Sites.

KOI Thé takes reasonable steps to maintain appropriate physical, technical and administrative security to help prevent loss, misuse, unauthorized access, disclosure or modification of personal information.

While we take these reasonable efforts to safeguard your personal information, no system or transmission of data over the Internet or any other public network can be guaranteed to be perfectly secure.

Privacy Policy Updates

 

We may update this privacy policy from time to time. When we do so, we will post the new privacy policy on this page and change the date of the policy.

We recommend you to check the date of our privacy policy when you visit this Site for any updates or changes. We will notify you of any modified versions of the privacy policy that might affect the way we collect, use or disclose your Personal Information. The changes will have immediate effect once announced on the Platform.
